H1B Packaging
The USCIS requests a preferred order of submission for H1B documents. Copies of all forms are located in section 4.1. The preferred assembly is:
- Completed and Signed Form I-907 (optional for premium processing)
- Completed and Signed Form I-129 (with necessary documentation in filing order)
- Cover Letter
- Form I-129 with original signatures(pages 1-6, 11, 12, 17-19)
- If the H is being ported from another employer, the three most recent pay stubs and current employer letter
- Photocopy of Labor Condition Application ETA 9035
- Statement of Tax Exempt Status
- Evidence of the highest degree with area of study, or diploma and transcripts listing area of study
- C.V.
- Nonimmigrant history including most recent I-94, visa (even if expired), and passport bio page with proof of passport expiration
- If porting or extending the H status, include all I-797 H1B approval notices
- If changing status from J to H, all DS2019s and 212e waivers if applicable
- If changing status from F to H, all I20s and Employment Authorization Documents if applicable
- Make three copies of I-129 package providing the original and an additional copy with PIMS cover sheet in H1B package, a copy for the employer files, and a copy to the applicant.

- Fees – (Checks made payable to U.S. Department of Homeland Security, stapled to Form I-129 with original signatures)
- If applicable, dependent I-539 form and proof of family relationship
- Mail with tracking! To USCIS Service Center (www.uscis.gov for most current address)
