Form I-129
This form is used to ask the Department of Homeland Security for permission to hire a temporary worker. There are three parts to the form: The I-129, the H Supplement, and the H1B Data Collection and Filing Fee Exemption. These forms are located in section 4.1. The following documents are necessary to complete the I-129:
- Immigration Certification Documents
- Educational Background Documents
- A Contract Letter for Employment
- The Labor Certification Application
Documents Required from the Applicant:
In order to process the information and forms for an H1B petition, documentation will be needed from the applicant including:
- Curriculum Vitae
- A copy of the most recent 1-94 (U.S. Entry)
- Most recent visa
- A copy of the photo/biography page of the passport as well as proof of the passport expiration date
- A copy of the highest academic degree. If the diploma does not list a specific area of study, transcripts are also needed
- If in F1 status, copies of all I20s and all EAD cards if applicable
- If in J1 status, copies of all DS2019s and 212e waiver if applicable
- If currently in H1B status, all H1B and I797 approval notices; three most recent pay statements; and a dated statement on letterhead attesting to current employment, signed by someone with hiring authority.
